The General Directorate of Pension Services of Social Security Institution Directorate has published a Circular dated 07.05.2020 and numbered 2020-12 (“Circular”), regarding the social insurant who have applied to the health care servers for being exposed to Coronavirus ( COVID-19) pandemic.
Within this scope, it has been stated in the Circular that COVID-19has affected almost all countries in the world througha rapid global spread and has been declared as pandemic by the World Health Organization. Furthermore, it has also been emphasized tin the Circular that Turkey has also been negatively affected by this pandemic.
Sickness status has been defined in article 15 of Social Security and General Health Insurance Law numbered 5510 (“Law) as discomforts which are not work accidents and occupational diseases and which cause an incapacity to work for the social insurantwho are in the scope of subparagraph (a) and (b) of the first paragraph of article 4 of the same Law.
Accordingly, it has been stated that, considering that COVID-19 virus is a contagious disease, the applications of the social insurant who have been exposed to the pandemic and applied to the health care servers will be evaluated under the scope of sickness.
As a result, in accordance with the Circular, the status of the social insurant having COVID-19 will not be deemed as work accident and/or occupationaldiseaseand the applications of the social insurant will not be evaluated under the scope of work accidents and/or occupational diseases but will be evaluated under the scope of sickness.
